Requirements for the Path to Becoming a Lawyer

Article 27 of The Bangladesh Legal Practitioners and Bar Council Order, 1972 states that an individual meets the following requirements in order to be eligible for admission as an advocate:

• The individual needs to be a citizen of Bangladesh.

•  He needs to reach the age of twenty-one years;

•  (i) He has to graduate with a legal degree from any university located within Bangladeshi territory; or

         [Note: Any accredited university in Bangladesh may offer a 4-year LL. B (Hons) or a 2-year LL.B. pass program; however, the course must be finished before 2018 as these two-year passes are no longer permitted.]

         (ii) Any comparable international course may be accepted with the Bangladesh Bar Council’s express consent or

         (iii) A law bachelor’s degree from any non-Bangladesh university accepted by the Bar Council;

•  The candidate must serve as a pupil for six (six) months under a practicing attorney who has at least ten years of experience in the field;

• He has to complete any exam that the Bar Council may require;

                He has to comply with all requirements outlined in the rules established by the bar council, including paying the enrollment fee.

Bangladeshi law graduates life after graduation

Regardless of their academic degree, law graduates in Bangladesh as well as abroad are not permitted to practice in courts. Law graduates can only work as apprentice lawyers until they receive authorization to practice after passing the bar council exam. Most of the trainee lawyer’s life in Bangladesh is difficult. They have to work and study in a system that is not productive . And ultimately does not care about the suffering of trained lawyers.

Moreover, apprentices are only received with warmth by senior advocates if they’re lucky enough to have a close relative who works as a lawyer.

For this reason, both enrolled and apprentice attorneys prefer to work for respectable legal firms rather than starting their private practices.

As more individuals get law degrees and new law schools are opening up at an even faster pace, competition for jobs in the legal field is growing. 

The process of hiring newly trained lawyers can be very time-consuming, as it is hard to detect if their ability to cope with the expectations placed on them is not in the wrong place, and the main problem is the compensation, which is hardly enough to support one person, it is not even enough to support a family.

The Judicial Administration and Training Institute (JATI) in Bangladesh has the possibility to expand its authority. Overview of The Path to Becoming a Lawyer

1. First and foremost, get your law degree (LLB degree or LLB Hons).
2. The student is required to complete a six-month training program. Or internship under the guidance of a senior advocate from Bangladesh with ten years of experience.
3. Upon completion of a six-month training program or internship, the student will be qualified. Now they can take the bar exam and become an advocate in Bangladesh.
4. There are three phases to the bar enrollment exam:

(a) Multiple-choice questions,

(b) written, and

(c) live exams overseen by the enrolment committee.

The Bar Council may award the student a Certificate of Enrollment to practice as an advocate in Bangladesh’s subordinate courts if they satisfy the Enrollment Committee after passing all of the preceding requirements.

An advocate may get the right to appear before the High Court Division of the Supreme Court of Bangladesh after two years of practice.

Someone may be eligible to practice before the High Court immediately without taking the bar exam if they have ten years of experience holding judicial office. Once the Bar Council issues a certificate, the individual has the option to register with the Local Bar Association as an Advocate. The Board will interview them, without that they will not be permitted to practice before any Bangladeshi subordinate court.
